1. Application owner and operator

Arak Time Attendance is operated by Arak Alnukhba Aljadida, Kingdom of Saudi Arabia. Questions related to these terms may be sent to: info@arakalnukhba.com.sa.

2. Eligibility and authorized use

The application may be used only by authorized employees, contractors, representatives, or approved users who have been granted access by the company or an authorized administrator.

The user may use the application only for legitimate work-related attendance, check-in, check-out, attendance history, and related administrative purposes.

3. Account activation and device binding

The application may require a one-time activation code, mobile password, device binding, and other security controls. A user may not activate, register, or use another person's account, device, activation code, or credentials.

The company may revoke, reset, suspend, or reissue mobile access when needed for security, operational, administrative, or compliance reasons.

4. User responsibilities

The user is responsible for:

• Using the application only for authorized work-related purposes.
• Keeping the mobile device, password, activation code, and access credentials secure.
• Not sharing the account, device, password, activation code, or attendance access with any other person.
• Maintaining required device permissions, including location permissions where needed for attendance verification.
• Keeping the device operating system and application reasonably updated where required.
• Reporting lost devices, suspected unauthorized access, incorrect attendance records, technical issues, or security concerns promptly.

5. Prohibited actions

The user must not:

• Use fake GPS, location spoofing, emulator manipulation, unauthorized VPN manipulation, or similar tools to falsify attendance.
• Modify, reverse engineer, bypass, disable, interfere with, or tamper with the application or related systems.
• Attempt to alter device identity, application behavior, network traffic, attendance records, GPS signals, or security controls.
• Use another person's account, device, activation code, or credentials.
• Submit false, misleading, fraudulent, or inaccurate attendance actions.
• Attempt unauthorized access to the application, dashboard, APIs, servers, databases, logs, or infrastructure.
• Use the application for personal, public, commercial, illegal, or non-work-related purposes.

6. Location and attendance verification

The application may use location data, GPS accuracy, device integrity signals, server time, and other technical checks to verify attendance actions. The company may approve, reject, audit, investigate, or correct attendance records based on application data, operational records, company policy, and applicable laws.

The application is not intended for continuous personal tracking. Location is used for attendance-related verification where required.

7. Attendance records and administrative review

Attendance records created by the application may be used for attendance management, workforce administration, project reporting, payroll review, audit, compliance, dispute handling, and operational decisions.

The company may review, verify, approve, reject, correct, or investigate attendance records if there is suspected error, device issue, policy violation, misuse, fraud, or inconsistency.

8. Availability and technical limitations

The application may be affected by network availability, GPS accuracy, device settings, operating system restrictions, battery optimization, permissions, server availability, maintenance, updates, or circumstances outside the company's reasonable control.

The company may update, modify, suspend, restrict, or discontinue any part of the application where needed for security, maintenance, compliance, operational requirements, or business needs.

9. Security

The user must not attempt to bypass security controls, abuse the system, scan or attack application endpoints, extract tokens, intercept traffic, manipulate requests, or access data not assigned to the user.

The company may log security events, investigate suspicious activity, revoke access, reset credentials, or take administrative action where misuse or risk is detected.

10. Privacy

Use of the application is also subject to the Privacy Policy, available at: https://www.arakalnukhba.com.sa/privacy-policy/.

11. Intellectual property

The application, design, software, workflows, documentation, logos, names, and related materials are owned by or licensed to Arak Alnukhba Aljadida or its authorized licensors. The user receives only a limited, non-transferable, revocable permission to use the application for authorized work-related purposes.

12. Third-party services

The application or related systems may rely on third-party services such as hosting, connectivity, security, cloud, analytics, messaging, app distribution, operating system services, or map/location services. Availability and operation of such services may be subject to third-party terms and technical limitations.

13. Suspension and termination

The company may suspend, revoke, restrict, or terminate access to the application at any time where required for security, employment status, contract status, policy violation, suspected misuse, device loss, technical risk, compliance, or operational needs.

14. Limitation of operational responsibility

To the extent permitted by applicable law, Arak Alnukhba Aljadida is not responsible for attendance errors, service interruptions, rejected attendance actions, delayed synchronization, inaccurate location results, device incompatibility, or failed access caused by user misuse, disabled permissions, fake-location tools, unsupported devices, poor network coverage, GPS limitations, operating system restrictions, unauthorized modifications, third-party service limitations, or circumstances outside the company's reasonable control.

Nothing in these terms limits rights or obligations that cannot be limited under applicable law.

15. System records and evidence

The user acknowledges that application records, server records, device binding records, timestamps, location verification results, GPS accuracy indicators, security events, audit logs, and related technical records may be used by the company as operational evidence for attendance verification, administrative review, investigation, dispute handling, and compliance purposes.

The company may rely on such records together with other operational information when approving, rejecting, correcting, auditing, or investigating attendance actions.

16. Right to reject or review attendance actions

The company may reject, delay, review, correct, or investigate any attendance action if there is a suspected error, device issue, missing permission, poor GPS accuracy, fake-location indicator, duplicate device usage, account sharing, network inconsistency, security alert, policy violation, or any other circumstance that affects the reliability of the attendance action.

17. Mandatory updates and access control

The company may require the user to update the application, re-activate the device, reset the mobile password, re-enable required permissions, or complete additional verification steps. The company may block outdated, insecure, modified, unsupported, or non-compliant application versions or devices.

18. Administrative action for misuse

Any unauthorized use, account sharing, fake-location use, device tampering, attempted bypass, fraudulent attendance action, or violation of these terms may result in access revocation, device deactivation, attendance record rejection, administrative review, disciplinary action, contractual action, or legal action, in accordance with applicable laws and company policies.

19. No guarantee of automatic attendance acceptance

A successful application submission does not necessarily mean that the attendance action is finally approved. Attendance actions may remain subject to validation, synchronization, administrative review, audit, correction, rejection, or approval according to company policy and applicable laws.

20. Compliance with laws and company policies

The user must comply with applicable laws, internal company policies, information security requirements, attendance rules, employment or contract obligations, and administrator instructions related to the application.

21. Changes to these terms

The company may update these Terms of Use when application features, legal requirements, operational requirements, security controls, or business needs change. The updated version will be published on this page with a revised update date.

22. Governing law

These Terms of Use are governed by the applicable laws and regulations of the Kingdom of Saudi Arabia, without prejudice to any mandatory rights or obligations that apply under relevant laws.
